এটাকে কি ধর্ষণ বলা যাবে?

"হত্বা ছিত্ত্বা চ ভিত্ত্বা চ ক্রোশন্তীং রুদতীং গৃহাৎ।
প্রসহ্য কন্যাহরণং রাক্ষসো বিধিরুচ্যতে।।"

(মনুসংহিতা, তৃতীয় অধ্যায়, শ্লোক ৩৩)

ভাবানুবাদে ব্যাখ্যাসহ অর্থ হল, "বলাৎকারে (i.e rape) কন্যা হরণ করিয়া বিবাহ করার নাম রাক্ষস বিবাহ। এ বিবাহে হরণকালে যদি কন্যাপক্ষীয়েরা বিপক্ষ হয়, তবে তাহাদিগকে হত বা আহত বা প্রাচীরাদি ভেদ করত কন্যাহরণ প্রসিদ্ধ আছে। ইহাতে কন্যা 'হা তাতঃ! হা ভ্রাত! তোমরা রক্ষা কর, আমার গৃহ হইতে হরণ করে' এইরূপ চীৎকার করিয়া রোদন করিতে থাকে...."

George Bühler এর ইংরেজি অনুবাদ এভাবে করেছেন, "The forcible abduction of a maiden from her home, while she cries out and weeps, after (her kinsmen) have been slain or wounded and (their houses) broken open, is called the Rakshasa rite." source: https://www.sacred-texts.com/hin/manu/manu03.htm

অর্থাৎ, কোনো মেয়েকে জোর করে উঠিয়ে নিয়ে গিয়ে তার সাথে শারীরিক সম্পর্ক করলে সে মেয়ে বৈধ স্ত্রী হয়ে যাবে!

পরের শ্লোকে আরও বলা হচ্ছে,

"সুপ্তাং মত্তাং প্রমত্তাং বা রহো যত্রোপগচ্ছতি।
স পাপিষ্ঠো বিবাহানাং পৈশাচশ্চাষ্টমোহধমঃ।।"

অর্থাৎ, নিদ্রায় অভিভূতা বা মদ্যপানে বিহ্বলা অথবা অনবধানযুক্তা স্ত্রীকে নির্জ্জন প্রদেশে গমন করার নাম পৈশাচ বিবাহ। এই বিবাহ আটপ্রকার বিবাহের মধ্যে পাপজনক। ইহা অতি অধম জানিবে। (মনুসংহিতা ৩:৩৪)

ইংরেজি অনুবাদে George Bühler লিখেছেন, "When (a man) by stealth seduces a girl who is sleeping, intoxicated, or disordered in intellect, that is the eighth, the most base and sinful rite of the Pisakas."

অর্থাৎ, কেউ যদি তার ঘুমিয়ে থাকা বা অন্য কোনো কারণে বেহুঁশ বা অচৈতন্য থাকা অবস্থায় কোনো মেয়েকে নিয়ে তার সাথে শারীরিক সম্পর্ক করে বিবাহ করে, তাহলেও সেই বিবাহ পাপযুক্ত হলেও সেই বিবাহ হয়ে যাবে!!! আহা! পৌত্তলিকতা সমাজকে উন্নত করে না! বরং কুসংস্কার ও ধ্বংসের দিকে ধাবিত করে!

মহাভারতেও রাক্ষস বিবাহের অনুমতি আছে:

"সর্বমোট আট প্রকারের বিবাহ পদ্ধতি রয়েছে। সেগুলো হল ব্রাহ্ম, দৈব, আর্ষ, প্রাজাপত্য, অাসুর, গান্ধর্ব, রাক্ষস এবং পৈশাচ - এই আট প্রকার....
...এমনকি রাজাদের (ক্ষত্রিয়দের) জন্য রাক্ষস বিবাহও অনুমোদিত..."
